Constructive Eviction at Villa del Sol

Constructive Eviction at Villa del Sol

A personal record of constructive eviction, habitability violations, and whistleblower retaliation—documented clearly, so there can be no denial later.

I’ve been through a lot of sh*t. A weaker woman would have folded by now. Maybe a weaker woman is smarter. But I’m still standing (sort of), and still documenting. Why? Because this isn’t just about me.

This is Constructive Eviction, and it is happening in Fresno, in plain sight.

What This Means (Plain Language)

Constructive eviction is when a landlord, HOA, or management company makes conditions so unsafe or unlivable that a person is forced to leave.

It’s not a lawful eviction. Instead of due process, they weaponize conditions—utilities, mold, chemicals, harassment—to drive you out.

Under California law, habitability is not optional. Tenants and homeowners alike are entitled to safe, livable conditions.

Receipts They Can’t Ignore

Sink Chemistry Experiments

First it was grey/black/brown. Now it’s blue. Chemicals rising from my bathroom sink—before any grey/black water enters the system. These photos aren’t filters; they’re the raw reality of what’s being pushed back into my home.

A/C Sabotage

My air conditioning worked fine when inspected by techs on Tuesday. By Wednesday, hot air was blowing through the vents while the unit was “off.” The breaker is not under my control, meaning they can manipulate my HVAC from outside my unit.

Deadly Mold

Ignored, covered, and used as leverage. Mold is not an accident here—it’s a weapon.

Paper Trail Games

Notices arrive without response paperwork. A process server “dancing” outside trying to lure me out. The “Contact Bridgman” flyer removed and replaced with a summons for $12,000 in fines/fees—this time for “bicycle riding” attributed to a former roommate.

Corporate Takeover Disguised as Eviction

I cannot sue for the corporate takeover process itself. But I know this: they need the appearance of an eviction. By making it look like I’m no longer the owner, they justify whatever comes next.

The Bottom Line

I am not fighting for damages.

I am not fighting for a payout.

I am fighting for the overage that is rightfully mine—so I can move forward with my life.

And all I want is my frikk'n⛵ boat.

Yes, I know: I’ll probably have to find a way to own the dock too. Otherwise it’s just another HOA with water.

This isn’t about greed. It’s about survival, freedom, and closing one chapter so I can start the next.
